Website scope and acceptance

These Website Terms of Use (“Terms”) apply when you access or use the Brunswick Landing Marina website, including its pages, forms, uploads and other online features (the “Site”). “Brunswick Landing Marina,” “we,” “us” and “our” refer to the marina and its Boat Yard operations as applicable.

By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

Information on this Site

We use the Site to share information about the marina, Boat Yard, amenities, rates, programs, events, downtown partners and related resources. We work to keep that information useful and current, but conditions change. Content may be corrected, updated, suspended or removed without notice.

Photographs are illustrative and may show past events, former staff, seasonal conditions or amenities that are not continuously available. Maps, measurements, descriptions and other property information are general references unless expressly included in a signed agreement.

Reservations, rates and services

Submitting a reservation inquiry, quote request, service form, application or other request does not create a reservation or require us to provide a service. A reservation or service engagement is confirmed only when the appropriate marina or Boat Yard team accepts it and any required agreement, deposit, payment or authorization is completed.

Availability, eligibility, timing and pricing may depend on vessel dimensions and condition, slip availability, occupancy, season, demand, equipment, staffing, weather, the scope of requested work and other operational considerations. The most current confirmed quote or signed agreement controls over general Site content.

Rates and policies may change. Unless a signed agreement says otherwise, displaying a rate on the Site does not guarantee that rate for a particular vessel, date or service.

Weather and marine information

The Site may display weather conditions, wind, modeled wave height, water temperature, fuel prices, tide or other marine information obtained from outside sources. This information may be delayed, estimated, unavailable or inaccurate and is provided only as a convenient general reference.

Do not use Site data for navigation, storm planning, emergency decisions or the protection of people, vessels or property. Check official forecasts, notices to mariners, charts and other appropriate sources, and exercise your own judgment. For an emergency, contact the proper emergency or maritime authorities.

Forms, files and other submissions

When you submit information or a file through the Site, you represent that it is accurate to the best of your knowledge, that you are authorized to provide it, and that doing so does not violate another person’s rights or applicable law.

We may use a submission to evaluate and respond to your request, administer marina operations, maintain business records, prevent misuse and carry out the purpose described on the form. Personal information is handled as described in our Privacy Policy.

For a boat-for-sale submission, you represent that the vessel is currently located at Brunswick Landing Marina, that you are authorized to advertise it, and that you have the rights needed for us to edit and display the submitted listing information and photographs on the Site and in marina newsletters. Submission is free, does not guarantee approval or continued publication, and does not make Brunswick Landing Marina the seller, broker or agent. We may correct, reject, remove or allow a listing to expire. Sellers and brokers remain responsible for accuracy, availability, lawful advertising and all transaction-related duties.

The emailed seller-portal link is private and permits changes to every boat listing associated with that verified profile. You are responsible for keeping the link secure and promptly contacting the marina if you believe it has been shared or misused. Material listing or photograph changes may require renewed staff review.

Additional permissions shown on a form also apply. For example, photographs submitted through the marina-moments form may be used in the ways described in that form’s authorization. Please do not upload malicious code, unlawful material, confidential information that we did not request, or content you do not have permission to share.

Acceptable use

You may use the Site for lawful, personal and legitimate business purposes related to Brunswick Landing Marina. You may not:

• interfere with the Site, its security or another person’s use of it;
• attempt to gain unauthorized access to accounts, systems, submissions or data;
• submit false, misleading, fraudulent, abusive or unlawful material;
• use automated tools to scrape, overload or disrupt the Site except as permitted by law or with our written approval;
• impersonate another person or misrepresent your authority; or
• use Site content, names or marks in a way that suggests an unauthorized endorsement or affiliation.

We may restrict access, disregard a submission or take other reasonable action when we believe the Site is being misused.

Third-party services and links

The Site may include or link to services operated by others, including reservation platforms, maps, calendars, forecasts, marine-data providers, review sites, social networks, downtown businesses and payment or communication services. Their own terms and privacy practices apply when you use them.

We do not control those services and are not responsible for their content, security, availability or actions. A link or embedded service is provided for convenience and does not necessarily constitute an endorsement.

Content, photography and trademarks

The Site’s original text, design, graphics, photography, video, logos, program marks and other content are owned by Brunswick Landing Marina or used with permission and are protected by applicable intellectual-property laws.

You may view, print or save reasonable portions of the Site for personal, noncommercial use. You may not reproduce, modify, distribute, sell, publish, create derivative works from or commercially exploit Site content without written permission, except as allowed by law. Brunswick Landing Marina, Boat Yard, Yacht Club and Downtown Partner marks may not be used to imply authorization, affiliation or participation without our approval.

Disclaimers and limitation of liability

The Site is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim warranties relating to the Site, including implied warranties of merchantability, fitness for a particular purpose and noninfringement. We do not promise that the Site will always be available, uninterrupted, secure or error-free.

To the fullest extent permitted by law, Brunswick Landing Marina and its owners, officers, employees and agents will not be liable for indirect, incidental, special, exemplary, punitive or consequential damages, or for lost profits, data, use or opportunity, arising from or related to the Site or third-party services linked from it.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited. Rights available to you under applicable law remain in effect.

Changes, severability and governing law

We may revise these Terms as the Site or our practices change. The effective date above identifies the current version. Continued use of the Site after a revision means the revised Terms apply to that use.

If a provision of these Terms is found unenforceable, the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver of it.

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles. Any dispute arising specifically from these Terms or use of the Site will be brought in a court of competent jurisdiction in Glynn County, Georgia, unless applicable law requires otherwise.
